Islamabad High Court Orders Transfer of Bushra Bibi from Bani Gala to Adiala Jail

The Islamabad High Court has issued a written decision directing the transfer of Bushra Bibi, wife of Prime Minister Imran Khan, from Bani Gala to Adiala Jail. The court's decision, issued by Justice Mian Gul Hasan Aurangzeb, cited concerns over the violation of fundamental rights and the lack of justification for Bushra Bibi's solitary confinement.

In the 15-page judgment, the court emphasized that solitary confinement is not only a form of punishment but also amounts to torture. It stated that Bushra Bibi's punishment was made more severe by being kept in solitary confinement.

The court decision highlighted the deprivation of Bushra Bibi's fundamental rights, including the inability of her children to visit the house due to its designation as a sub-jail without proper permission from the owner. The notification declaring the Bani Gala residence as a sub-jail was deemed null and void by the court.

Furthermore, the court questioned the lack of justification provided by the Chief Commissioner for declaring Khan House as a sub-jail, emphasizing the necessity for transparency and adherence to legal procedures.

The decision also noted that the transfer of Bushra Bibi to Adiala Jail as a convicted prisoner lacked proper authorization from the Inspector General of Prisons. Despite being considered a woman of high sensitivity by the Superintendent Jail, the court found the transfer unjustified, particularly as her husband, Imran Khan, remains in the same jail without similar privileges.

The Islamabad High Court underscored the state's responsibility to protect Bushra Bibi's rights while in prison and emphasized the need for proper legal procedures to be followed in her transfer.
