ISLAMABAD: A new controversy has erupted in the Islamabad High Court following the suspension of an interim order issued by Justice Babar Sattar. Despite the division bench's suspension, Justice Sattar proceeded to hear the case and issued an 8-page written order, questioning the suspension's legitimacy.
The written order expressed concerns over the Chief Justice’s interference and the failure to implement the court's directives, including the removal of judicial orders from the court website. Justice Sattar raised significant questions regarding the actions of the Deputy Registrar Judicial, who did not include the case in the cause list as per court instructions.
The order underscored that under the Law Reforms Ordinance, an intra-court appeal could only be filed against a final decision and not against an interim order. The case is set for the next hearing on May 7, with the Registrar's Office instructed to include it in the cause list.
In a further development, the court summoned the Deputy Registrar Judicial and Deputy Registrar IT for the next hearing. The controversy stems from Justice Sattar’s earlier show-cause notice to the DG Immigration and Passport and the NAB Director for contempt of court, which had been suspended by the division bench led by Acting Chief Justice Sarfaraz Dogar.
In related proceedings, the hearing of the trial of civilians in military courts continued, with Attorney General Mansoor Usman Awan outlining the key points for the court's consideration, including the right to appeal and the impact of the government’s policy decisions.
