The Pakistan Muslim League-Nawaz (PML-N) has filed a petition in the Peshawar High Court, seeking immediate administration of oath to members elected on reserved seats in the Khyber Pakhtunkhwa (KP) Assembly. The move comes amid growing concern over delays that could potentially impact the upcoming Senate elections scheduled for July 21.

According to sources, six women and one minority member nominated by the PML-N have submitted a formal letter to the Election Commission of Pakistan (ECP), alleging deliberate delaying tactics in administering their oaths. These members were officially notified by the ECP on July 2, following the Supreme Court’s ruling on reserved seats issued on June 27.

The letter underscores that under the Constitution of Pakistan (1973), elected members cannot perform legislative duties or cast votes until they have taken the official oath. It highlights that despite multiple requests to the Speaker of the KP Assembly, no arrangements have been made for the oath ceremony.

Furthermore, the letter cites Article 255 of the Constitution, noting that if the Speaker fails to act, the Chief Justice of the Peshawar High Court holds the authority to nominate someone to administer the oath. The members have urged the ECP to formally request the Chief Justice to intervene and facilitate the oath-taking process.

With the Senate elections in KP just days away, the inability of these members to take their seats in the assembly has sparked political tension. Critics argue that withholding the oath undermines parliamentary rights and could impact the balance of power in upcoming legislative votes.

Legal experts suggest that if the High Court rules in favor of the petitioners, the court may direct the ECP or the judiciary to immediately administer the oath and prevent disruption to the democratic process.

The outcome of this legal battle could play a critical role in shaping the Senate elections and the broader political landscape in Khyber Pakhtunkhwa.
